Legal Question in Real Estate Law in California

I am a resident manager of an apartment building and the owner of the building does not want to rent to smokers. I believe we can because it is not a "protected class" but if we decide to do that can we continue to allow existing smokers in the building to smoke in their apartments?

That is unclear. Smokers are not a protected class so you might be able to get away with it on the argument the existing smokers moved in on the belief they would be able to smoke.
