Legal Question in Real Estate Law in California

retrieving bail bond

My uncle put his house along with other properties up for bail for another family member of mine but now that family member has already self surrendered. I was wondering how I can get those properties back. I didn't go to a bail bond agency to do the bond. Instead, I did the paperworks myself. Can you tell me what I should do next?

Re: retrieving bail bond

I would add that the bonding company should be more helpful in assisting clients in obtaining exoneration of bond. Go to the bonding company and tell them they owe you a little cooperation and explanation. Take the court papers relating to the status of the case with you.

When he surrendered the clerk in the Judge's court should have exonerated the bail. You probably need to go to the court and get a certified true copy of that document or minute order, and record it. That's if the court recorded anything when you put the property up for bail. However, a good place to start is the criminal clerk at the counter, and then go where ever they tell you to go.

Everything depends on the contract. You will not get the bail bond back until at least the case is over. I would be happy to review the terms and conditions of your agreements without charge if you fax them to me at 714 363 0229.
