Return of Rental Apartment Security Deposit

My former landlord has refused to return our security deposit on the apartment we vacated since december 1998. We had a one year lease contract from September 1998 to August 1999. In October 1998 we gave one month notice of intent to vacate. The apartment was rented to another tenant by the time we moved out. Can we sue for the security deposit?

Yes, go to small claims court and sue for the entire deposit and a $200 penalty. He is required to refund the deposit within 2 weeks of your leaving.
