Legal Question in Real Estate Law in California

Revoking a 30-Day Notice

I have submitted a 30-day notice to vacate to my landlord. The

one-year lease has expired, and I currently live month to month.

Due to problems with my future residence, however, I might need

to revoke this 30-day notice. Firstly, can I revoke it, and, if so, how

many days before the move-out date do I have to revoke it?

Thank You For Your Time.

Re: Revoking a 30-Day Notice

You can't revoke the notice, but you can try to work something out with your landlord. The new agreement, if any, should be in writing and signed by both of you.

Re: Revoking a 30-Day Notice

You cannot revoke the notice without the landlord's consent. After all, he may have already signed a lease with a new tenant. But even without that your notice is effective unless the landlord agrees to revoke it.

I suggest that you talk to the landlord and explain the situation. You are not the only one ever to have this problem and most landlords will cooperate.
