Legal Question in Real Estate Law in California
Our rights when landlord is being foreclosed?
I need to know what we can do. We found out recently that our landlord may be being foreclosed on the 5th of December. What we have heard is he owes over 3500, which means he has not paided the morgage since we moved in. We were told that we may be able to not pay him anymore. About 2 weeks ago he called and left a message offering to let us buy the house. When we returned his call about 2 days later, we left a message, he has not bothered to call us back or anything. He is a cronic lier, which we found out too soon. We would like to find out what we can do to keep the house, and if we need to continue to pay rent. We also found out he has filed bankruptcy.

You may have a right to withhold rent until he can furnish evidence that he is current on his mortgage payments. A bankruptcy on his part will not stop a foreclosure, only postpone it.
