room addition responsibility

we rent a house that has an aluminum patio room addition in not-so-good condition. its roof leaks in one corner of the room and we have plans to tear it down. however, the renters wanted the room to use as an extra bedroom and we disclosed the above information to them prior to renting the property. they are now complaining that the roofs leaks (obviously) and is making us fix it, regardless of the fact that we will tear the structure down. are we required to fix this?

You have options available to you. You can negotiate with the tenant to allow you to remove the patio room. If they are unwilling to allow you to remove the patio room, you can give them a 30 day notice terminating the tenancy, assuming that it is a month to month tenancy. If you do give the thirty day notice, do not give a reason for the 30 day notice.

If there is a lease, then you will have to attack the problem in a different way. You will need to have the assistance of an attorney to help you solve this problem.
