Legal Question in Real Estate Law in California

My roommate (not on lease) is skipping out on 3 month of rent. What can I do legally do kick him out and get back the money? He wrote a promise note saying that he will pay all of it but has not payed back.

Small-Claims Court is probably your best legal option. Before filing a small claims lawsuit, I'd suggest two things. First, consider whether there are kinder and gentler ways to collect, including his willingness and financial ability to pay up. Then, get one or more of the self-help law books covering "how to prepare, file, win and collect" in California small-claims court. One good publisher is Nolo Press, but there are others.
