Legal Question in Real Estate Law in California
Saturday morning our roof started leaking & it ruined our new mattress (we've had it 4 months). The guy that came to fix it said a pipe from the hot water heater upstairs leaked. That it had a hole in it that had been patched up w/ tape & that he had now properly fixed it. I figured because it was a maitanance issue, the property management company would reimburse us for the mattress, but according to them its not covered by their insurance so they wont reimburse me. That I should have had renters insurance (True, but even then I'd have a co-pay). But what about the fact that we wont be able to sleep in that room for at least a week? It still has two holes in the ceiling that they told me to air out w/ fans for a week & they are just going to come and look at the carpet tomorrow (Luckily we have a carpet cleaner & were able to suck up some water). Should they deduct part of my rent for not being able to use this room for at least a week? And not to mention the cost of my light bill going up due to the fans going on all day in there?

The fact that tape was placed over a prior leak or hole shows negligence on the part of the owner. I suggest working it out if possible with the owner/ management company, and get some person to person legal advice before withholding rent.
