Legal Question in Real Estate Law in California
Section 8 Housing
We bought a home in November and just found out the home next to ours is being rented Section 8. We had no idea about this at the time of purchase and never thought to ask because it is a neighborhood where the homes range from $800,000 to over $1m. Was this something that should have been disclosed to us at the time of purchase?

Re: Section 8 Housing
I agree with Ms. Deming. It would seem that the agent would get in trouble for disclosing that the neighbor was receiving federal housing assistance. It would be tantamount to an agent telling a prospective purchaser that a person from a different racial or ethnic background lived in the neighborhood.
Very truly yours,
Re: Section 8 Housing
Unfortunately, no; in fact, disclosing to you that the people occupying the house next door are receivng public assistance, might be considered "discriminatory." Please note, however, if the value of the home next door is at or around 800K and the occupants are paying rent consistent with that value, this does not "smell" right; funds for participants under Section 8 are not provided so that recipients can live in upscale or ritzy dwellings.
