Legal Question in Real Estate Law in California
Getting a security deposit back on an appartment lease
It has been 29 days since we terminated our lease and moved from our apartment. The lease states the security deposit will be returned within 21 days but we have not received it yet. I called the management company and they said the deposit would not be recieved for another 2-3 weeks.
Do we have any rights in getting them to pay sooner?
Are there any laws stating they have to pay interest if not paid within 21 days?
In some states if they do not pay within the time specified, they must pay back the full deposit and can not deduct for any damages. Is this the case in California?
Thanks

Re: Getting a security deposit back on an appartment lease
You should go to small claims court to ask for your deposit back and seek punitive damages of $600 under Civil Code Section 1950.50. If you fax me the lease and all correspondence to 714 363 0229, I will provide you with free consultation.
