Security Deposit

My property manager is a real jerk. We feel like we are under duress and have been taken advantage of from day 1. My rent is $4200.00/month and I have a $6,000.oo security deposit, that I feel I won't see a penny of. I am tired of being compromised and I am considering not paying my last 2 months rent. I sent him a letter w/several grievances and he refuted each one with a controversial noncommital answer. This is a bad guy, I do not trust him and I feel trapped.

Even real jerks win lawsuits. It is the quality of your complaint, not the quality of the prospective defendant, that measures the merits of your case. Evaluating your situation would require more information about the dispute, not the manager. I suggest presenting your case on its merits to a wise but disinterested third party (attorney, experienced businessperson, real estate professional, etc.), saying nothing about personalities, etc. before resorting to self-help such as withholding rent.

Is this a commercial lease or a residential lease. Not paying the rent would work, but it could damage your credit and your ability to lease elsewhere. If you want to break your lease I would advise talking to an experienced broker / attorney first.
