Legal Question in Real Estate Law in California

Security Deposit Refund

Before moving into our apartment, we did a very thorough walk-through of the premises and recorded any damages. Upon moving out, we did another walk-through of the apartment. The property manager commented how clean the apartment was. It was noted that the paint of some cabinet doors and door frames were peeling and that we would not be charged. The only things that were mentioned during the walkthrough that would be a charge for a new grill for the refrigerator, cleaning of the outside windows, and cleaning the carpet. All which we agreed to.

When we received our security deposit there were additional deductions: apartment cleaning ($50) and paint ($112.50).

We inquired about the additional deductions. These things were deemed by the women that gets paid to clean the apartment as charges we should also have to pay. This is what the property manager told us. She said the interior cabinets and walls were marred so the whole apartment had to been repainted. If this cleaning woman has such authority why wasn't she present at the walkthru?

Re: Security Deposit Refund

If you disagree with the deductions, or think that you were being charged for ordinary wear and tear, rather

than any damages, take the matter to small claims court.
