Legal Question in Real Estate Law in California

Hello,

Im seeking advice on how to handle living in a potentially illegal in-law unit in San Francisco.

I live in an in-law unit in San Francisco and on 3/27, I received an e-mail from my landlord indicating that my month-to-month lease would end on 4/31/13 and would not be renewed. Furthermore I was given 30 days notice so that the original owners of the building could move in and take occupancy of both my unit and the unit above me by 6/1/13.

Several friends have told me that my in-law unit might not have the proper permits and might be illegal but I have no way of knowing how, or if I should call the Dept. of Building Inspection. In a complicated twist, landlord and building owners are very vindictive when it comes to me flexing my rights as a tenant. I once informed the landlord that my neighbor was acting so crazy that I might have to call the police to protect myself and the landlord replied that, Any further police involvement will force me to discuss this with my attorney. If so, legal proceeding may result and the rents will begin to sky rocket. I've done this before and it is not pretty. This type of rhetoric makes me think that if the landlord or the owners get one whiff that Ive alerted the Dept. of Building Inspection, things will get nasty, quick. I want to make sure that Im doing this by the book so that I dont slip up and lose in court.

What should I do or who should I speak to?

Thanks for your help,

-Nick

Go straight to the San Francisco Rent Board. http://www.sfrb.org/ What they are trying to do is not legal. They may or may not have the right to occupy the property, but not the way they are doing it.
