Legal Question in Real Estate Law in California

Selling a house in joint tentantship

I own a house with my ex fiance and would like to sell it asap, he is currently in jail and may be unwilling to sell, he also put a 35,000.00 lien on the house against me which I do not think is valid. He put for electrical services rendered, but did not do anything and I have no contract. I think he did it to foul me up if I try to refinance or sell. My payment will be going up really high and I need to sell the house. Can I take it to a judge to make the house be sold? He is in jail on charges of stalking me and I have a restraining order against him. We do have one child together, I would like to make it so his share of the equity goes into an account for her child support, can I do that?

Did he record a mechanic's lien? Odds are it's invalid and can be expunged by a simple motion (meaning taken off title). Let me know if you would like me to look into the matter.

As to child support, you would likely need to consult with a family law attorney about that. I can refer you to one if you wish (in So.Cal.)
