I was served papers that had mu husbands name on it, is this legal?

Yes. It is called substituted service. If they try to serve him personally, and he is not at home, they can give it to anyone over 18 who is there, and then mail a copy to the same address. Service is effective the day they mail it, and he gets ten extra days to respond.

If they attempted to serve your husband, and you were home, it is substituted service as Mr. McCormick points out.
