Legal Question in Real Estate Law in California

Shared garage door problem

I live in a condo with a 2 car garage which I share with my neighbor. His girlfriend was parked just a little too close to the garage. As I approached the driveway I opened the door with the remote and the door ended up jamming between the girlfriend's license plate and bumper leaving a good size scratch. They want me to pay half of the damages but I don't feel I should since she knows that the door opens out and had parked too close.

Am I in the right?

Re: Shared garage door problem

This is not a real estate question, it properly belongs under the LawGuru subject heading having to do with the tort of negligence. Nevertheless, the answer seems so obvious that even a real estate lawyer might take a shot at answering it. It seems obvious to me that you are not responsible for the scratch. Probably the girlfriend who did the sloppy parking job is responsible for her own harm, but I suppose there is a remote possibility that whoever laid out this silly parking arrangement in the first place is truly to blame. If you want an authoritative answer, re-ask your question under our "torts" or "negligence" heading.
