Legal Question in Real Estate Law in California
One side of the roof caves in and rest is on its way!
Good Morning. My mom is a breast cancer patient and I am her caregiver. My mom has made arrangements to pay the rent towards the end of the month because of the way her disability payments come in. Since she does this, she is afraid to report this situation. The ceiling began to leak (I thought it was due to the rain but it was due to the pipes), it leaked so bad that streams of water was coming down. This particular day I did not want my daughter sleeping where she normally sleep because I had a feeling something was going to happen. Well the roof fell in on the spot she would have been sleeping. You could see the sky and she just had the maintence worker put up a panel board. The other side is starting to crack and since the water is going down/inside the wall. The sockets began to spark out. I am talking about blue/white light shutting out of the socket. Well I am going to take photos this week because no major repairs have been done, since first reported a couple of weeks ago regarding the fallen roof. PLEASE HELP!!!!

This question really should have been asked under the "Landlord and Tenant" category, and I suggest you re-ask it under that category and you'll probably get more answers and perhaps better answers.
However, I will give it a try, because I think immediate action is needed.
I think the failure of a tenant to report some observed problem like leaking pipes may be a breach of an obligation on the part of the tenant. A tenant should not sit silently and idly by while the damage grows worse and worse.
I'm not sure a landlord can successfully sue the tenant for damage occurring after failure to report a leak, but it would not surprise me.
