Legal Question in Real Estate Law in California

Small Claims

We were the defendant on a contract dispute. We won the money in escrow. The planitff filed an appeal. We went to court again and won. The escrow company holding the money will not release it. I have shown them the document from the court. I have filed a Writ of Execution. Can this help? How long does this take? The escrow company was notified on Jan. 24, 2000 that we won the case and was given the document from the court. What can be done?

Re: Small Claims

you need to ask the escrow company why the wont release the money. you could also take them to small claims court.

Re: Small Claims

You should serve the writ on the escrow company and if it does not pay then sue for the amount of the judgment and damages. Those damages would include costs incurred in attempting to recover the money, after the judgment was obtained.
