Legal Question in Real Estate Law in California

If one state treats a mortgage modification violation as a civil matter and another state treats the same violation as a criminal matter, is this difference sufficient to appeal to a federal court?

No. That doesn't even make any sense. Every state is entitled to make the laws they see fit for anything that happens in that jurisdiction (subject to federal pre-emption which would take several hours to really explain and doesn't apply to your question). Furthermore, you can never appeal a state court proceeding to a federal appeals court.
