Legal Question in Real Estate Law in California
statute of limitations on refund
Is there a statute of limitations on returning excess money from a foreclosure sale on property in contra costa county california? The trustee paid one half of the funds to my ex-husband but said they could not locate me. He received funds in February 2002, the house was sold in 1997.

They cannot keep it. Generally, after a certain period of time, it would be sent to the state of California. Go to the website for the State Controllers office. From there you can find out if they are holding the funds for you.

The foreclosure company can not keep the money. It has to be interplead into court. Please call me at 714 363 0220 if you need assistance in obtaining the funds.
