Legal Question in Real Estate Law in California
I can stay but my dog can not.
On June 3rd I gave my landlord 30 days written notice to vacate the propperty, which is required on our lease agreement. Four days later she gave me written notice that I had to find another place to keep my dog until the 30 days was up. She rented the place to me with my dog. We have been there 11 months. There are extenuating circumstances: My dog is a nipper and does something called fear biting. He is not at all vicious. I consider myself a responsible pet owner and have taken steps to solve the problem. I built a dog run on the property with the landlords permission. I posted ''Beware of Dog'' signs on two fences. We are in training classes to try and solve the problem. I keep him on leash when we leave the yard. I have asked the landlord not to let the dog out of the dogrun when I am not home but she does so anyway. Which resulted in one case of the dog biting the pool man. She knows the pool man comes on Thursdays but she let him out of the dog run anyway. Is it legal for her to ask that my dog leave before I do?

Re: I can stay but my dog can not.
She can ask, but she cannot force you without a court order. It would take her much longer than 30 days to obtain.
