Legal Question in Real Estate Law in California

can you HELP stop lock out?

I go a 5 day notice and was told a bk would stay the process. Now I fear it will not.

Can I appeal the summery judgement in an emergency?

You need to call an attorney in your area. You don't have the time to wait for someone to call you back. Call a bankruptcy attorney in your area immediately.

Re: can you HELP stop lock out?

Bankruptcy won't prevent a lockout.

Maybe an attorney can do something for you at this point -- why did you wait until now? -- but I can't think of anything. One point: Usually a 5 day notice comes after you have already been sued for unlawful detainer and lost. If the 5 day notice is really the first notice you have had of the unlawful detainer lawsuit, you can apply to the court for relief from default.

Please be sure to remove your personal property before the lockout, or it will be gone!
