Legal Question in Real Estate Law in California

Subleasing

I am currently subleasing a room in my apartment. The sublet is not on the rental agreement with the landlord. I have accepted her 30 day notice to vacate, therefore terminating her 6 month agreement with me. She does not want to pay the last month's rent and has requested that I use her security deposit which is supposed to be used for her part of the bills. What rights do I have if she does not pay me the last month's rent? What steps do I have to take to get her out of the apartment if she doesn't pay me her part of the rent?

Re: Subleasing

You should not accept her last months rent. Serve her with a 3 day notice to pay rent. If you have any qujetions and she does not move out, I could help you with an unlawful detainer. Please call me or Barry at my office

Re: Subleasing

You can't get her out of the apartment with out court intervention. You can sue her in small claims court for any damages you suffer, such as her part of the bills.
