Legal Question in Real Estate Law in California

Subletter Leaving Mid May-- Pay Full Rent?

I moved into an apt to share a room

with a girl for the term of a

semester-- which I took to mean

until Graduation. On Apr. 27th, I

reminded her that I was moving out

May 19th, and said I would be more

than willing to pay for the 2 weeks

and five days I would be staying.

She began throwing accusations at

me, saying she assumed I was saying

all summer, etc. etc., and that I

should pay at least all of May rent. I

gave her notice, and my name is NOT

on the lease-- do I have to pay the

full months rent?

Re: Subletter Leaving Mid May-- Pay Full Rent?

Rental agreements do not have to be in writing. It is better they are because in your case there is no agreement as to when you planned to leave. Are there any factors which would support your leaving version, such as your being from another geographic area, job offer somewhere else, going to graduate school elsewhere, etc. If there was a firm date already established as to when you would leave, then there should not be any problem with not giving 30 days notice.

So you probably are within your rights to not pay anything after 5/19.
