Legal Question in Real Estate Law in California

who to sue?

I own 4.5 acres of partially developed land. The owner of the adjacent parcel had a surveyor mark his land, the results showed what we believed was ours is actually his. He then logged the land . When we found out all of this occured we looked into it and the property was marked correctly in the first place. Who pays for logging our land and destroying the developed areas of our property?

Re: who to sue?

We have handled a similar case. There are special codes relating to logging of timber on the lands of others. Call if you want to discuss this further.

Re: who to sue?

I regret that this is an unfamiliar area of the law to me. The general property law would make the owner of the adjacent land responsible for damages for logging on your land. However, there are many differences involved with the logging industry. I suggest you talk to Ms. Cowin and/or look for lawyers who specialize in this area.
