Legal Question in Real Estate Law in California

Can you sue an escrow company for opening and holding important tax information they received in the mail addressed to yourself that has now caused you real money damages? My escrow company had been receiving mail addressed to me and not forwarding it to my new address. They held on to the mail for over 9 months only forwarding it to me once they received a letter from the tax assessor stating my wages were going to be garnished. All this could have been avoided had they forwarded my mail to me. I could have filled out the parent to child transfer exemption. Now I have a 5000 dollar tax bill because the form was not returned on time. The escrow company wrote their address on the Affidavit of death of trustee that was recorded with the county so the tax assessor says they mailed it to the proper place for notification.

It sounds like you may have a valid case, but at the dollar amount you mention you're talking about a small claims court matter.
