Legal Question in Real Estate Law in California

I am getting sued for past due HOA payments and was served with a citacion judicial summons on 10/23-2011, have 30 days to respond. Hoa duea have also became a lien on title of the house. House is now listed as a shortsale n agent is asking bank to pay Hoa n clear title . What should i do about summons?

As the summons instructs.

You need to prepare, file and serve a responsive pleading, usually an Answer, responding to the Complaint served with the Summons.

The fact that you may have a short sale coming in the future and that your agent is trying to get the bank to advance some money to pay the HOA lien does not have any bearing, at least at present, on the fact that you have been sued. Failure to respond to the Summons will eventually lead to the HOA obtaining a default judgment against you.
