Legal Question in Real Estate Law in California

suspension of election of new board members

Our board called an emergency board meeting, and decided to suspend our election, after ballots have gone out and members of voted. The board did so because the management company was leaving on April 30th. And they said they wold stay on for 30 days after, to pay the bills. The election is on April 22nd, so what's the problem. Besides, the board knew the management company's contract was up. They've been our management company for three years. Is it legal for the board to suspend elections like this.

We would like the new board to be repsonsible for hiring a new management company.

Re: suspension of election of new board members

Whether they can or not under the ByLaws, they did. Unless someone is willing to press the matter in court, which requires a four figure investment, nothing will change.
