Taking occupancie before sales finale

I am in the process of selling my house in Southern California. I recieved an offer on the house and accepted the offer. All of my paperwork was signed and submitted, I then relocated to Northern California. The buyer of the house took possesion before the sale was final. It has now been three months and I want possession of my house back. How do I go about eviciting the person in the house. Their was no written or verbal lease agreement. This person has paid only one month rent in the three months they have lived their.

Did you use a real estate agent? If so, call his broker and demand that they either get the sale closed or arrange for eviction.

Otherwise, you will need to file an unlawful detainer in order to force them out.
