Legal Question in Real Estate Law in California
if a tenant commits murder in a rented apartment what are the legal rights for the landlord as for the property that was abandon
1 Answer from Attorneys
The fact a crime was committed does not change your responsibilites toward the property. You should take detailed pictures of everything, make a detail list statilng iln what condition and estimated value the item is, etc. Write the tenant telling him he has a reasonable period of time up to XX to have someone pick the items up or what you will do with them, if anything has more value than $25 try to sell it for a good price. You can then tell him what the items sold for, what you threw away as worthless, how much you are applying to cleaning charges and past due and future rent, and then arrange with his attorney or prison authorities to send the remainder to him.
