Legal Question in Real Estate Law in California

Is the tenant or the landlord responsible for the $250 move-out fee in a condo? The CCR state all residents must pay this fee and the lease states the tenant shall abide by the CCR.

I apologize, however, this question requires a lot more facts to answer. One would need to review your lease, the CC&Rs;and the facts of the matter before providing an opinion as to whether or not you owe it. I assume that this is a high-rise condo, and the $250 move-out fee is paid to the HOA as a result of the special work they have to do to protect their halls, elevators, etc... and for having to staff the move-out? If so, you may be liable, but I cannot give you a solid opinion without reviewing a lot more information. Hire a local attorney to review and give you an opinion as to the enforceability of this provision.
