Legal Question in Real Estate Law in California

Tenant Rights after reporting landlord

Recently I reported my landlord to the Code Enoforcement Division, here in fresno for a roach infestation he refuses to take care of. now he has threatened to raise my rent for me reporting him. An told the code enforcement investigator, that i cleaned my house just prior to the investifator showing up and also blamed my cats and dog food for the roach problem here. I along with other tenants have told him repeadedly that there is a roach problem and he takes his own sweet time fixing it, there are also othe repairs in my place that need to be done. the carpet is coming apart at the seams all over the place, there is a patch of mold under the paint in my bathroom, what are my rights and can he attempt to evict me? Please Help!

The investigator informed him that my animal food was not to blame and that my house is kept clean, i cant even mak iced tea cause the roach come out in my tea pot, they are in everything everywhere, i have a computer tvs, scanners, i have lost 200.00 in colectable diecast cars because of the roaches, can i make him replace the things that were damaged?, thank you in advance

Re: Tenant Rights after reporting landlord

The landlord cannot evict you to retaliate for your reporting a problem to Code Enforcement. You may need legal help to fight this if the landlord goes ahead anyway. I suggest you talk to him and tell him that he cannot evict you for 6 months after your complaint.

As for the damage to your property, I can't evaluate that on the facts you gave. If the landlord caused damage to your property, you should be able to recover that in small claims court if the damage is less than $5,000. The small claims courts usually have advisers who can inform you how the court works and how to bring a case there.
