Legal Question in Real Estate Law in California

I have a tenant that has over stayed her lease by one month and refuses to pay. I just found out that she rented another place and has been moving out things little by little. she has not confronted me about when she is going to be out and still has alot left to move. Today is the 31, what can I do? I want her out and my keys back.

This is why landlords get security deposits. If the security deposit doesn't cover unpaid rent plus any damage she has done, your recourse is to Small Claims Court.

If she stays without paying rent, you have her served with a 3 day pay or quit and you evict. When her lease ended, she became a month to month tenant. You need to inform her that she needs to give you 30 days notice of her intent to move. If she moves out before you can evict her, you can convert the unlawful detainer to a case for unpaid rent.
