Legal Question in Real Estate Law in California

Tenants rights

My son was renting a room from friend of the family. They gave him 30 days because he didnt have a job. There was no rental contract, nothing in writing. Now he wants to sue them for unlawful eviction. Is that even possible? What can he sue for?

Re: Tenants rights

Thanks!

He has no legal basis to sue. Without a rental agreement, your son has a month-to-month tenancy and that type of tenancy can be terminated without any reason by the landlord upon giving a 30 day notice. If he sues, he could be held responsible for paying the landlord's cost and legal fees in defending it, so I would not advise your son to sue.

Thank you.
