termight work

we have closed escrow and the termight work was not finished it has been 50 days sence the close of escrow. the shower pan and sub floor was dryrot damaged. they came in and replaced the shower pan with out fixing the sub floor. as in the contract. I took pictures and sent the termight co. A email that the work was not right the floor was suink from the dry rot after a week thay sent a crew to fix the floor.they were trying to replace the wood with new wood over the dry rot crossmembers. I called the termight co. He told me thats all he had to do. I strongly dissagreed . ALL the dry rot needed to be replaced. after talking to the contractor and the termight co. they would try to fix it . so the next day I went back to see the work. One of the workers told me that he needed to remove the shower pan to fix it right. the next day thay riped the shower pan out and replaced the roted wood . The next day thay floted the floor and shower pan but did not put the tile in. thay have not been back to finish the job. escrow payed them with out checking if the work has been compleated. we can not use the house becuse the floor and shower is not finished. No one wants to help us get it finished. who should we take to small clames ?

You could sue the contractor for damages. You should get a licensed contractor inspect the bathroom and give an estimate to complete the repairs. Then contact the state contractor's board and report this contact. Check with the contractor's license to determine the status of his license. The state contractor's board is often slow, but you will need an estimate for the repairs to take to court to show your damages.
