Legal Question in Real Estate Law in California

Thrown from property with 24 Hrs Notice...

We sold 77.5 Acres to California City Studios with the terms that we would retain

possesion till 8/1/2001. One week after closeing escrow the Broker informed us we had

only rights to possess one of the two units on the property.

threats of shutting our power off and an agreement to allow the new owner access to the rear of

the property. One California City Policeman that was upset about my calls about the owner

threating to''Come on the Property'' and ''Dig a hole in front of the Gate'' threatned to cut the lock and let the new owner enter . On 5/262001 my

wife recieved a call from Officer Fender of the California Police Department and we were ordered

''Off the Property in 24Hours because I am letting the new owner in'' . We tried to move in the alotted

time and lost many personal Items and are now living in a Motel in Tehachapi. Other events

have happened and I have lost my Job because I worked at home .(Real Estate Appraiser)

Do we have any rights? Can we sue for non performance and harrassment. The Broker is

involved with the Studio and did not disclose this fact We need help.............

Thank You

Re: Thrown from property with 24 Hrs Notice...

Who did the broker represent? Sounds to me like you may have a claim for breach of contract, possibly fraud, trespass, etc. I need to know more facts. You may be able to get a forcible detainer which would allow you back onto the property. It all depends on the facts. You may call me for a free telephone consultation at 818-998-1584. I am located in the San Fernando Valley, however I may be willing to prosecute a case for you in your area!!
