Legal Question in Real Estate Law in California
Tree Removal
Two of my neighbors planted trees that they knew would grow to cover more than half my back yard. In the past I have paid thousands of dollars to keep the trees pruned from my property. I can no longer afford to prune their trees, but the branches have now grown more than 70 feet onto my property, from both locations. Can I legally force the removal of the trees.

Re: Tree Removal
I have done an agreement before related to maintenance of a tree that caused this and other problems. There may be legal theories under which you can recover damages, such as trespass, and/or push your neighbor to formalize an agreement to maintain the trees. I do not know how much of my time it would take, maybe a letter, some negotiating, drafting of an agreement, hopefully not a lawsuit. If you are serous about spending attorney time on trying to resolve this issue, please email my office.
