Legal Question in Real Estate Law in California

Tree root damage

The Benicia rental home I received in the divorce settlement, and which I have moved into, is suffering severe tree root damage from trees outside of my property. North of my house and between my neighbor, and me, is a narrow greenbelt area in which the trees are growing. The roots have lifted, separated and cracked my driveway, garage and back patio. Also, on the South side of the home, outside my fence line and adjacent to the 780 freeway, roots have severally damaged my foundation. Additionally, the realtor that sold me the house is my ex-wife. Where do I start for remedy and do I have any hope?

Re: Tree root damage

It's your problem unless the trees causing the property belong to a neighbor.
