Legal Question in Real Estate Law in California
Our tree roots have grown into our neighbors yard. It is cracking his cement. He wants us to cut down our 25 year old tree and pay for his cement damage. We believe it is an act of nature or God. We have no control over where the roots grow. We live in Sacramento, CA. What are our legal obligations?

Contact your homeowners insurance. The should handle. You are responsible the damage your tree creates.

I agree with Mr. Selik. If the trunks of the trees are on your property, you own them, and are responsible for damage caused by their roots that encroach on your neighbor's property and cause damage.
