Legal Question in Real Estate Law in California

Tree roots responsibility

I have been notified by an atty., acting on behalf of an adjoining owner, that tree roots on a parcel of residential property that I own in Lake Forest Ca ., have caused damage to a wall. The wall is owned & maintained by the adjoining owner .Am I liable ? If so does my homeowners policy on the property cover this damage .I have not confirmed that damage has actually been done or that my tree is the cause ,if damage has occurred.

Thank You

Re: Tree roots responsibility

I don't know the answers to your questions. However, I've lived in El Toro (Lake Forest) since 1974. So I'm familiar with the area and can go look at the problem for you. Your Home Owners Insurance Policy probably covers the roots. However, it is a raw guess for me to say that. Since I'd need to review the policy. And if your house is in either Lake Forest I or II, and is subject to either of their homeowners' associations. That might make a difference. My home is a couple of blocks off of the intersection of Muirlands and El Toro Road. My telephone number is (949) 859-7117. There will be no fees charged to go look at the house or contact the attorney that sent you a letter.
