Legal Question in Real Estate Law in California
Trouble with Mortgage Company
My refinance was complete four months later than promised. I was asked to sign pre and post-dated forms, always assure that everything was fine, etc.
I never received disbursement papers until the day after the loan closed. It was enclosed with the credit card payoff checks that we were told had been paid days before (causing lates on my credit report) to our creditors. The Loan Company paid, not according to our requests, but randomly..ie left a balance on the second mortgage, left a large bill unpaid, etc. They also shorted us $14,000 in the cash we were promised. As late as the day we received $10,000 instead of $24,000 deposited into our bank account, the broker said, ''Don't worry, they do it in two deposits''. The next day I received the dispersal papers and, it balanced but was far short (About $24,000) from the amount requested.
I have an excellent email trail of all of this including an email where the broker tells us he's using a ''fictitious address'' for some reason. (I know, I should have known something, but they were so nice and made it seem like an everyday occurrence!)
Where, if anywhere, do I go from here?

go to an attorney who specializes in real estate law/refinancing --- the refinancing part is very specialized and somewhat rare so you need an expierenced, 10 to 15 or 20 years, in the r.e. spseialation --- you have at least 2 potential defendants who hopfull are insured. get your inial contract, and all paperwork in order and get the attorney yesterday
