unlawful detainer

a unlawful detainer was filed with the court and served to us on 11-7-08. i am just wondering how much longer we have untill we have to get out? it looks like another court date is set for 1-16-09 but i can barely read it the ink is very light.

If the case is in Riverside County Superior Court, I'd suggest logging on to their Web site and searching for your case by your name, the plaintiff's name, or the case number. Try www.riverside.courts.ca.gov and then follow the menu via "case information" etc.

I do not know if the site has info on unlawful detainer cases, but I'd bet it does.

Failing that, my best guess is that the date is the date for hearing the case, and if you don't file and serve an answer, it will be a default hearing and the landlord will get a jusgment and a writ of possession. Within a few days of the issuance of the writ of possession, the sheriff will be around to help you move. I think the minimum is three days after the hearing, and it could be a few days longer if the sheriff is busy. 1/19 is M.L. King Jr. Day so I'd guess 1/20 could be your last day.
