Water damage in condo complex...Whose insurance covers the repairs?

A small water leak caused during original construction due to pipes being cross threaded 22 years ago has caused the bathroom ceiling of unit below to cave in. Who's insurace covers the repairs? I've read a bit about simular issues and the majority of what I have read states that that is what insurance is for. Unfortunately the unit with the damage is the one who pays. Is this true ? Being taken to small claims court this coming friday.

I'm not certain that any insurance will pay for the damage as the statute of limitations has run on a construction defect action. However submit it to your insurance company and have the Homeowner's Association submit it to theirs. As condominium owners only own the space within the walls of their unit, repairs generally are the responsibility of the homeowner's association.
