Legal Question in Real Estate Law in California

Water damage

I just purchased a condo back in May 07 and one of my water valves underneath my bathroom sink broke (could not shut off valve) and flooded part of my bedroom and water flowed to the unit downstairs causing minor damage to the hardwood floors. She refuses to put a claim through her insurance so I'm trying to see if my home insurance will cover it but in the even that it does not am I held liable for an unforeseen act?

Re: Water damage

You are certainly more responsible than downstairs neighbor is.

Your insurance should cover liability like this. Have you notified your company? I am not a big fan of insurance companies, however, as they became rich by denying, or lowballing, every possible claim.

You may also have a claim against contractor, or even product liability claim against valve manufacturer.

You need legal advice from an attorney, and representation beyond getting some quickie answers from "Law Guru". Let me know if I can help you further.

Good luck!
