Legal Question in Real Estate Law in California

Water Drainage

We live down a private road. There is another house in front of ours which fronts the public road. These owners have only lived here a year so we don't know them very well. We have a drainage ditch which runs along the private road out to the public road into a larger drainage ditch. We maintain the ditch in front of our property(keep out weeds, etc). The new property owner has not maintained the ditch along his property. The portion of the drainage ditch which runs along the front of our house is approx 100' the portion which runs along the side of the other party's property is approx 200'. What are our rights about asking these owners to maintain this ditch.

Re: Water Drainage

Usually county or city ordinances requires that people who have drainage ditches on their property of the type you are describing must maintain those ditches.

If your property is within city limits, contact the city. Otherwise, contact the county.
