Water/Flooding rights

A small creek that flows through our property has become damed near its' mouth which has in turn created the flooding of 40+ acres of pasture and the county road. The property owner who ownes the damed section of stream is showing no intention of fixing the problem. Is there any legal action that can be taken to force the issue???

Yes. You can sue the landowner causing the obstruction or the landowner whose property the obstruction is upon for whatever damages you have sustained, as well as to remove the obstruction.
