Legal Question in Real Estate Law in California
Last year I was hired as a Trustee of a Trust to prosecute an UD Action because the Original Trustee was out of state. The UD case was dismissed w/out prejudice and I was relieved as Trustee early this year. Three months after I was relieved, I am being sued as an individual and Trustee (along with several defendants) in a Quiet Title Action filed 5 months ago by the UD defendants in L.A. County, CA. I timely filed a Demurrer arguing that I am no longer affiliated with the Trust which was overruled and thereafter I timely filed my answer and a Short Caused Trial is set for the middle of next month. The plaintiffs' attorney has proven to be unethical by filing a POS stating they served the Summons/Complaint on me and the Trust (CCP Sec. 415.95) by mail and their Opposition to my Demurrer at a UPS Store on the other defendants. The plaintiffs recently filed a Request of Default which the Court entered against the other defendants who were never served because the Manager of the UPS Store have refused all the services, who will sign a Notarized Affidavit to this. What can I file to prove that the plaintiffs are perpetrating fraud on the court. Thank you.

Who cares about the other defendants? You are not an attorney and cannot represent others. Why aren't you consulting with an attorney over this?
