Under Family Code section 6701(b), a minor cannot make a contract relating to real property or any interest therein. A minor is someone under the age of 18 who has not been emancipated by appropriate court action.

Please note that this is not to say that a minor cannot own real estate........they can inherit it.

A minor can also hold a beneficial and future interest in real estate if title is currently held by an adult custodian under the Uniform Transfers to Minors Act, Probate Code sections 3900 et seq.
