personal small claims

i was buying a car from friend. we had a deal that i will finish the payments on the car and i can have it. she told me the wrong price on the car and when i asked her about it she said she wants the car back with out giving me back my money. i want my money back but dont know where and how to start going about it.

You might start by buying or borrowing a book about California Small Claims Court procedures - how to prepare, file, present and win your case. Another thing to keep in mind is that legal ownership of automobiles is tracked and regulated by a system of legal documents including the certificate of title or so-called "pink slip." Possession of the pink slip is of some importance, but even more important is who is shown as owner and lienholder thereon and in the DMV's records. If you have money coming to you as a refund or as damages for breach of oral contract, small claims is the place to go after negotiations break down, but remember the pink slip is evidence the judge will want to see if you claim ownership of the vehicle rather than just money damages.
