Legal Question in Securities Law in California
I am a security guard at a country club in Southern California, and I was asked a question I couldn't give a precise answer to. It has a couple of parts to it. Are process servers agents of the court? Is it legal to turn them away? Can I impose hours on them, such as entry between 7am 7pm?
Any help would be appreciated.
1 Answer from Attorneys
Process servers are registered with the county in which they primarily operate. Unless they are sheriff's department employees, they have no relationship with the county nor with the courts. It is legal to turn them away by peaceful means. However, if they know you are home, they might leave their papers on your doorstep and mail you a copy. You can impose hours on them, but they need not heed them. Generally, process servers will stop attempting service about 9:30 p.m. You might be surprised, though, because eventually they will be able to effect service, or the attorney will obtain a court order to allow posting on your front door and then mailing it to you.
